Terms of Purchase: Baricol Bariatrics

Conditions

All prices quoted include VAT. We reserve the right to change prices without notice and correct incorrectly stated rates. Baricol Bariatrics does not reimburse costs for any change in the exchange rate of currency or the exchange cost of banks.

Order

Ordering can only be placed on the website and can only be made by persons aged 18 or over.  A completed order means the acceptance of the applicable terms and conditions as well as approval that specified customer data is registered in Baricol Bariatrics AB’s database. We reserve the right to correct orders if delivery cannot take place and the right to refuse or change orders.

Personal Data

In connection with ordering, the customer agrees that Baricol Bariatrics stores and uses the personal data in our business to complete and provide the service expected of us. All processing takes place in accordance with the General Data Protection Regulation.

Communication

In connection with ordering, the customer agrees that Baricol Bariatrics may use contact details to inform about offers, events, and other relevant information for the customer.  If the customer does not wish to receive this information, the customer shall notify Baricol Bariatrics by email.

Product Information

The product images on the website do not guarantee that the exact appearance and nature of the product are reproduced correctly. We reserve the right for any errors in the product information and reserve the right to change product information without prior notice. Baricol Bariatrics AB reserves the right to make any errors in product information or otherwise on the website. In the event of any inaccuracies, the right to correct this is reserved retrospectively. We reserve the right for price adjustments, final sales, inventory differences, technical problems, changes to    technical specifications and any typographical errors on our site or in our ads. We reserve the right to cancel incorrect orders.

Right of Withdrawal/Return

Private individuals have the right of withdrawal under the Distance and Home Sales Act. This means a right to cancel the purchase of certain goods within 14 days of delivery and the withdrawal period starts to run from the date you receive the product.The right of withdrawal applies only to consignments where the transport packaging has not been broken. To obtain a full credit, the item must be returned in the unaltered state.

If you wish to exercise your right of withdrawal, please send us a written message via e-mail  [email protected]  where you provide us with the following information:

  1. Order number. Available in your order confirmation, on the packing slip, or
  2. Your name and contact details
  3. The name and number of products desired to be returned

 

Baricol Bariatrics AB shall confirm that the return is permitted and that the withdrawal period had not passed before the goods are returned. You are a customer are responsible for the return cost and are responsible for the goods until they have been received by us. Returns may not be sent as cash advances or pre-paid free postage. Returns outside of the initial withdrawal period of 14 days are not allowed.  For subscriptions, the initial withdrawal period applies only to the first delivery. Returns within the withdrawal period are at the customer’s expense. Baricol Bariatrics takes responsibility for returns due to a defective or incorrect products. Returns should be sent as letters or parcels, not as cash on delivery.

Subscription

An ongoing subscription with Baricol® Complete means that vitamins are automatically delivered all at once according to the range selected when ordering. It is always possible to postpone the next delivery or move it forward. You change the flavour and/or product in the subscription between deliveries as long as it is done no later than 5 days before the next payment is scheduled. Termination of your subscription must be made in writing to [email protected] no later than 5 days before the next payment is due. Termination is only valid when the customer has received confirmation of this via email. Non-payment or an unclaimed package does not apply as termination.

Payment

In Sweden and Norway, all payments are made via Klarna Bank AB (publ) which offers payment by card and invoice. In connection with the purchase, a credit report will be taken, and the claim will be transferred to Klarna. Klarna’s general terms and conditions can be found at https://www.klarna.com/se/villkor/. Customers in other countries make payments through Stripe, which supports most known card providers. Read more about Stripe here: http://stripe.com/com All card payments are made securely according to the PCI DSS (Payment Card Industry Data Security Standard) standards.  No card information is handled or saved at Baricol Bariatrics AB.  The payment will be deducted directly from your account when you approve the transaction.

Supplies

There may be shipping costs on deliveries. Delivery time is up to 7 working days. Items that do not fit in a mailbox are handed over to a delivery point, after which a notification to the customer is made. The customer is responsible for keeping contact details in their Baricol Bariatrics account up to date.

Unclaimed Packages

We reserve the right to charge costs incurred for unclaimed packages and therefore currently charge a fee of 200 SEK, NOK  250, or 25 Euro based on the currency when the order was placed. The fee can be adjusted if necessary.  In cases where the customer gets in touch with Baricol Bariatrics and wishes to have the shipment sent again, Baricol Bariatrics reserves the right to charge a handling fee for this.

Complaints

Baricol Bariatrics AB complies with the provisions of the Consumer Sales Act.If you have received a faulty/defective item, please contact our customer service. The complaint should be made in accordance with the instructions you receive from us. Do not submit the item for return until you have contacted us. Complaints about transport damage must be made within a reasonable time. Therefore, upon receipt, check the package so that it is not damaged by transport. In the event of a dispute, we follow the General Complaints Board’s Recommendations. As an alternative, the EU provides the online dispute resolution service (Online Dispute Resolution or ODR) that can be used in the case of a dispute:  https://webgate.ec.europa.eu/odr/ If a complaint is accepted, Baricol Bariatrics AB will bear any shipping costs.

Product liability

Supplements are not sold for the purpose of having any medical effect, to treat injuries or diseases, nor to replace medicines or a normal healthy diet. To be used under the consultation a doctor or dietician.

 

Personal Data & Customer Communication

We will process the personal data that you provide or submit to us or that we collect on our website through cookies. The personal data we process is your name, email address, purchase, payment and order history, delivery address, IP address, phone number, and, if applicable, personal identification number. The personal data we process is protected through security procedures and organizational measures. The connection to the website takes place over an encrypted connection through SSL. We have firewalls and antivirus software that protect and prevent unauthorized access to our network. The customer agrees that Baricol Bariatrics AB can communicate by various means (e.g., letter, phone, e-mail and SMS) to inform about  product offerings. If you do not wish to receive offers from us during the subscription period or after the subscription has ended, you can decline this by contacting customer service.
